Terms of Use

1. Agreement

By creating a child profile or otherwise using Innatora (the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service. You must be at least 18 years old and the parent or legal guardian of any child you add.

2. What Innatora is — and is not

Innatora is a general-interest parenting and play-idea service. It is provided for informational and entertainment purposes only. Innatora is not:

  • a medical, psychological, psychiatric, or diagnostic service;
  • an assessment of intelligence, aptitude, giftedness, or disability;
  • educational, therapeutic, career, or financial advice;
  • a predictor of any child's future ability, achievement, or outcome;
  • a substitute for a qualified professional, teacher, or clinician.

Nothing in the Service creates a professional relationship of any kind. Always consult a qualified professional about your child's health, development, or education.

3. Your responsibility for activities

Activities suggested by Innatora are ideas only. You are solely responsible for deciding whether an activity is safe and suitable for your child, for supervising it, and for providing safe materials and environment. Activities may involve movement, tools, household items, food, water, or the outdoors, all of which carry risk of injury, allergic reaction, property damage, or death. You assume that risk entirely. Never leave a child unsupervised during an activity.

4. No warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content, insight, or suggestion is accurate, complete, or appropriate for your child.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNATORA AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.

6. Indemnity

You agree to indemnify and hold Innatora harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your content, your supervision of activities, or your breach of these Terms.

7. Acceptable use

Do not use the Service to record sensitive health or clinical information about a child, to harm or surveil a child, or in any unlawful way. Do not add a child you are not the parent or guardian of.

8. Changes and termination

We may modify, suspend, or discontinue any part of the Service, and may update these Terms. Continued use after an update means you accept the revised Terms. You may stop using the Service and delete your data at any time from your child's profile page.

9. Governing law and disputes

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law rules. Any dispute will be resolved in the courts located in Alberta, and you consent to their exclusive jurisdiction. Claims must be brought individually, not as part of a class or representative action, and within one year of arising.
